Lawsuit Challenging SB 10

On October 15, 2007, the Office of the Ohio Public Defender, the Ohio Justice & Policy Center, ACLU of Ohio Foundation, and Equal Justice Foundation filed a direct action in the Supreme Court of Ohio, challenging the constitutionality of Senate Bill 10’s retroactive application.  The complaint asserts that SB 10 violates the ex post facto, double jeopardy, and separation of powers provisions of the Ohio Constitution and the United States Constitution.

Thursday May 25, 2006: Washington, D.C.   Congress is poised to pass yet another very expensive and ineffective piece of legislation. HB 4472 / 1086 (otherwise known as the PROTECT act or the Child Safety Act) has passed the senate (by an unrecorded vote incidently) and will soon be moving to the house. No word yet on whether this will vote will be unrecorded as well.

At issue, once again, are sex offenders. Out of the 600,000 or so highly dangerous, waiting to jump out of the bushes and grab your kids, sex offenders in this country, 100,000 or so have not been registering like they’re suppose to. It could be because some of them are dead. Take a look at the Florida sex offender website (www3.fdle.state.fl.us/sexual_predators ).

You will find many individuals marked as deceased yet their photo and other identifying information remains in the database. Additionally, Florida in all their wisdom has statutorily mandated that anyone even visiting their state must register there as well. When they leave...oops... they forget to take them back off the registry. Some have probably fled the country. Others, committed suicide, or simply have no address to register due to the numerous residency restrictions. Many others have grown old and senile after being on the registry so long that they can’t even remember their name let alone the address of the convalescent home they now live in.

Lawmakers, who are always forthright, tell us 100,000 of these people are AWOL. No, they aren’t on parole or probation, they just failed to notify the sheriff of their old town or their new town when they move. I can’t imagine why. Maybe they were uncomfortable with the treatment they and their family members got by the community once the fliers went out.

100,000 give or take. One fifth of the total "registered" population. Of that 1/5 or 100,000 , two have re-offended against and murdered innocent children. Horrible and despicable. What do we do? How can we prevent this from happening again?

It’s rather simple really, HB 4472 has it all figured out. Make ALL 600,000, including the 500,000 that have been registering, pay the price for the two bad guys. Yes, make ALL 600,000 of them appear every 3 to 6 months in person to verify their addresses, be fingerprinted, photographed, weighed, measured, DNA samples taken, etc. Make them send in notarized letters every 30 days so we know that they’re where they say they are. Even though it is a known, (but very well hidden) fact that more than 95% of these people will never re-offend again and only a handful have the propensity to commit such a heinous crime as the ones for which all are now to be held accountable for. Again.

If law enforcement thought it was chaos before, then they’re going to love this new piece of legislation. It will bury the proverbial needles in the haystack, like John Couey and Joseph Duncan even deeper. The two registered...oops...I mean unregistered sex offenders.

Take a look at John Couey’s rap sheet (click here:_http://64.237.99.149/bk/coueyjoh.pdf), do you think he or someone like him is going to take any of these laws seriously and abide by them? Highly doubtful!

Now take a look at the other "bad apple" Joseph Duncan he murdered an entire family except for the young girl, which he kept alive so that he could molest her longer. This is HIS website. His blog: http://www.Bloggingthefifthnail.com. A law enforcement officer was conversing with him in the days before he went on his killing spree. Read it. It is clear to anyone with more than two brain cells that this man was very disturbed, even admitting that he was doing illegal things to get even with society but not getting caught. What on earth could have possibly prevented him from doing what he did? More stringent registration laws? Mailing in a notarized receipt once a month?

It’s time to cut the shit folks. These cases are few and rare. A psychological profile and comprehensive evaluation of this individual would have caught these psychopaths long ago. Psychologists readily admit that there are certain characteristics evident in these types of people even as early as the pre-school years. WHY aren’t we focusing on PREVENTION? Why must we wait for another child to die and make hundreds of thousands of families suffer the consequences for the acts of so few? Is this justice? Is this safety? What the hell is going on?

Of course we have the usual figure heads like John Walsh and the NCMEC, clamoring for this legislation, testifying before congress (even though this is likely illegal because they are a 501(c)) demanding that it be passed.

Yet still, they continue to push for legislation that causes more harm, grief and chaos that could ever be prevented. These people are out of control. So wrapped up in their anger and rage (or lust for money) that they are simply incapable of thinking rationally and it must stop, before another child dies.
